Trump signs new executive orders to narrow birthright citizenship—again
Weeks after the Supreme Court struck down his first attempt, the President tries a fresh legal route.
President Trump has signed two fresh executive orders aimed at limiting birthright citizenship, barely a month after the Supreme Court struck down his original attempt. The first order narrows who qualifies as a citizen at birth, whilst the second targets so-called “birth tourism”, directing agencies to restrict entry for expectant travellers seeking US citizenship for their children.
The move follows the Court’s 6–3 ruling in Trump v Barbara, which upheld birthright citizenship as a constitutional guarantee under the Fourteenth Amendment. The administration insists these orders fit within exceptions the Court itself recognised. Critics, including the ACLU, disagree entirely, calling the effort dead on arrival.
Consequently, further litigation seems inevitable. Thus, one question remains unresolved: How far can executive authority really stretch against constitutional precedent?
